						<section><p>When a pharmacist receives the request of any <span class="dictionary">person</span> that a <span class="dictionary">drug</span> or <span class="dictionary">drugs</span> for such <span class="dictionary">person</span> to be dispensed by the pharmacist not be placed in a safety closure container, the pharmacist may <span class="dictionary">dispense</span> such <span class="dictionary">drug</span> or <span class="dictionary">drugs</span> in such nonsafety closure container. The delivering pharmacist shall not be civilly liable simply by reason of <span class="dictionary">dispensing</span> a <span class="dictionary">drug</span> or <span class="dictionary">drugs</span> in such a container if the recipient signs a release covering a period of time or a single <span class="dictionary">delivery</span>, which release provides that the recipient releases the pharmacist from civil liability for not using the safety closure container, unless the pharmacist acted with willful and wanton disregard of safety.</p></section></text><history>1978, c. 839, &#xA7; 54-524.67:2; 1988, c. 765.</history><metadata></metadata></law>
