						<section><p>Any <span class="dictionary">person</span> who operates any <span class="dictionary">civil aircraft</span> within the <span class="dictionary">airspace</span> over, above, or upon the lands or waters of this Commonwealth, without being, at the time of such operation, in <span class="dictionary">possession</span> of a valid <span class="dictionary">airman</span>&#x2019;s certificate for such operation, issued under and in accordance with existing federal <span class="dictionary">law</span> shall be deemed to be guilty of a Class 1 <span class="dictionary">misdemeanor</span>.</p></section></text><history>Code 1950, &#xA7; 5-10.3; 1966, c. 576; 1988, c. 45.</history><metadata><court_decisions><item key="0"><name>Surface, Adm'x v.
