2005, c. 315; 2010, c. 794.","full_text":"A\n\nUpon the filing and investigation of an application for a license, and compliance by the applicant with the provisions of \u00a7\u00a7 6.2-2002 and 6.2-2003, the Commission shall issue and deliver to the applicant the license to engage in business under this chapter at the locations specified in the application if it finds that:\n\n1\n\nThe financial responsibility, character, reputation, experience, and general fitness of the applicant and its members, senior officers, directors, trustees, and principals are such as to warrant belief that the business will be operated efficiently and fairly, in the public interest, and in accordance with law;\n\n2\n\nThe applicant has made acceptable provision for the avoidance of conflicts of interest;\n\n3\n\nThe applicant maintains a separate trust account with an FDIC-insured depository institution for the handling of customers&#8217; funds;\n\n4\n\nThe applicant&#8217;s credit counselors are certified through a bona fide third-party certification provider unaffiliated with the applicant that authenticates the competence of counselors providing consumer assistance;\n\n5\n\nNo more than one-third of the board of directors or managing members are employees, officers, members, principals, trustees, directors, agents, or other representatives of organizations that grant credit to consumers;\n\n6\n\nThe applicant is accredited by the International Standards Organization or the Council on Accreditation or any other organization approved by the Commission;\n\n7\n\nThe applicant has fidelity bond coverage in such principal amount as may be determined by the Commission;\n\n8\n\nThe applicant (i) is not the subject of any current material administrative or regulatory proceedings by any governmental authority and (ii) has not received a material adverse determination in any past administrative or regulatory proceedings by any governmental authority; and\n\n9\n\nThe applicant has filed with the Commission a form, that shall be provided to each consumer prior to his execution of a DMP, that contains the following disclosures to the consumer: (i) all fees charged by the applicant or contributions solicited by the applicant from the consumer; and <a id=\"paragraph-1396319\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/6.2-2005\/#A8\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A9\" class=\"indent-1\"><p><span class=\"prefix-number\">9.<\/span> The applicant has filed with the <span class=\"dictionary\">Commission<\/span> a form, that shall be provided to each <span class=\"dictionary\">consumer<\/span> prior to his execution of a <span class=\"dictionary\">DMP<\/span>, that contains the following disclosures to the <span class=\"dictionary\">consumer<\/span>: (i) all fees charged by the applicant or contributions solicited by the applicant from the <span class=\"dictionary\">consumer<\/span>; (ii) whether the applicant is a for-profit <span class=\"dictionary\">entity<\/span> or nonprofit <span class=\"dictionary\">entity<\/span>; and (iii) whether the applicant received financial support from <span class=\"dictionary\">creditors<\/span> during the preceding calendar year. <a id=\"paragraph-1396320\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/6.2-2005\/#A9\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B\"><p><span class=\"prefix-number\">B.<\/span> If the <span class=\"dictionary\">Commission<\/span> fails to make such <span class=\"dictionary\">findings<\/span>, no license shall be issued and the <span class=\"dictionary\">Commissioner<\/span> shall notify the applicant of the denial and the reasons for such denial. <a id=\"paragraph-1396321\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/6.2-2005\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> A license shall not be issued to a collection <span class=\"dictionary\">agency<\/span>, or to any <span class=\"dictionary\">creditor<\/span> or association of <span class=\"dictionary\">creditors<\/span>, or to any credit-granting organization or association of such organizations. <a id=\"paragraph-1396322\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/6.2-2005\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nQUALIFICATIONS (\u00a7 6.2-2005)\n\nA. Upon the filing and investigation of an application for a license, and\ncompliance by the applicant with the provisions of \u00a7\u00a7 6.2-2002 and 6.2-2003,\nthe Commission shall issue and deliver to the applicant the license to engage in\nbusiness under this chapter at the locations specified in the application if it\nfinds that:\n\n   1. The financial responsibility, character, reputation, experience, and\n   general fitness of the applicant and its members, senior officers, directors,\n   trustees, and principals are such as to warrant belief that the business will\n   be operated efficiently and fairly, in the public interest, and in accordance\n   with law;\n\n   2. The applicant has made acceptable provision for the avoidance of conflicts\n   of interest;\n\n   3. The applicant maintains a separate trust account with an FDIC-insured\n   depository institution for the handling of customers&#8217; funds;\n\n   4. The applicant&#8217;s credit counselors are certified through a bona fide\n   third-party certification provider unaffiliated with the applicant that\n   authenticates the competence of counselors providing consumer assistance;\n\n   5. No more than one-third of the board of directors or managing members are\n   employees, officers, members, principals, trustees, directors, agents, or\n   other representatives of organizations that grant credit to consumers;\n\n   6. The applicant is accredited by the International Standards Organization or\n   the Council on Accreditation or any other organization approved by the\n   Commission;\n\n   7. The applicant has fidelity bond coverage in such principal amount as may be\n   determined by the Commission;\n\n   8. The applicant (i) is not the subject of any current material administrative\n   or regulatory proceedings by any governmental authority and (ii) has not\n   received a material adverse determination in any past administrative or\n   regulatory proceedings by any governmental authority; and\n\n   9. The applicant has filed with the Commission a form, that shall be provided\n   to each consumer prior to his execution of a DMP, that contains the following\n   disclosures to the consumer: (i) all fees charged by the applicant or\n   contributions solicited by the applicant from the consumer; (ii) whether the\n   applicant is a for-profit entity or nonprofit entity; and (iii) whether the\n   applicant received financial support from creditors during the preceding\n   calendar year.\n\nB. If the Commission fails to make such findings, no license shall be issued and\nthe Commissioner shall notify the applicant of the denial and the reasons for\nsuch denial.\n\nC.
