means the <span class=\"dictionary\">State Board<\/span> for Community Colleges.<br \/><br \/>\t\t\t&#8220;<span class=\"dictionary\">System<\/span>&#8221; means the Virginia Community College <span class=\"dictionary\">System<\/span>.<br \/><br \/>\t\t\t&#8220;<span class=\"dictionary\">Virginia student<\/span>&#8221; means any student who has established domicile in the Commonwealth pursuant to &#xA7; <a class=\"law\" title=\"Eligibility for in-state tuition charges; domicile; domiciliary intent\" href=\"\/23.1-502\/\">23.1-502<\/a>. <a id=\"paragraph-1321965\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/23.1-100\/#5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nDEFINITIONS (\u00a7 23.1-100)\n\nAs used in this title, unless the context requires a different\nmeaning:\t\t&#8220;Associate-degree-granting&#8221; means that an associate degree\nis the most advanced degree that is granted.\t\t&#8220;Associate-degree-granting\npublic institution of higher education&#8221; includes Richard Bland College and\neach comprehensive community college.\t\t&#8220;Baccalaureate&#8221; means that\nbachelor&#8217;s degrees or more advanced degrees, or both, are\ngranted.\t\t&#8220;Baccalaureate public institution of higher education&#8221;\nincludes Christopher Newport University, George Mason University, James Madison\nUniversity, Longwood University, the University of Mary Washington, Norfolk\nState University, Old Dominion University, Radford University, the University of\nVirginia, the University of Virginia&#8217;s College at Wise as a division of\nthe University of Virginia, Virginia Commonwealth University, Virginia Military\nInstitute, Virginia Polytechnic Institute and State University, Virginia State\nUniversity, and The College of William and Mary in Virginia.\t\t&#8220;Chief\nexecutive officer&#8221; includes the Chancellor of the Virginia Community\nCollege System, the Chancellor of the University of Virginia&#8217;s College at\nWise, the Superintendent of Virginia Military Institute, and the president of\neach other public institution of higher education.\t\t&#8220;Comprehensive\ncommunity college&#8221; means an associate-degree-granting public institution\nof higher education governed by the State Board that offers instruction in one\nor more of the following fields:\n\n1. Freshman and sophomore courses in arts and sciences acceptable for transfer\nto baccalaureate degree programs;\n\n2. Diversified technical curricula, including programs leading to an associate\ndegree;\n\n3. Career and technical education leading directly to employment;\n\n4. Courses in general and continuing education for adults in the fields set out\nin subdivisions 1, 2, and 3; or\n\n5. Noncredit training and retraining courses and programs of varying lengths to\nmeet the needs of business and industry in the Commonwealth.\n\t\t\t&#8220;Council&#8221; means the State Council of Higher Education for\nVirginia.\t\t\t&#8220;Dual enrollment&#8221; means the enrollment of a qualified\nhigh school student in a postsecondary course that is creditable toward high\nschool completion and a career certificate or an associate or baccalaureate\ndegree at a public institution of higher education. &#8220;Dual\nenrollment&#8221; does not include the enrollment of a qualified high school\nstudent in a postsecondary course that is not creditable toward high school\ncompletion.\t\t\t&#8220;Governing board&#8221; includes the State Board and the\nboard of visitors of each baccalaureate public institution of higher education.\n&#8220;Governing board&#8221; does not include local community college\nboards.\t\t\t&#8220;Local community college board&#8221; means the board\nestablished to act in an advisory capacity to the State Board and perform such\nduties with respect to the operation of a single comprehensive community college\nas may be delegated to it by the State Board.\t\t\t&#8220;Nonprofit private\ninstitution of higher education&#8221; means any postsecondary school, as that\nterm is defined in &#xA7; 23.1-213, in the Commonwealth that is exempt from\npaying federal income taxes under &#xA7; 501(c)(3) of the Internal Revenue Code\nand is certified by the Council to offer degrees or exempt from such\ncertification pursuant to Article 3 (&#xA7; 23.1-213 et seq.) of Chapter\n2.\t\t\t&#8220;Non-Virginia student&#8221; means any student who has not\nestablished domicile in the Commonwealth pursuant to &#xA7;\n23.1-502.\t\t\t&#8220;Private institution of higher education&#8221; includes each\nnonprofit private institution of higher education and proprietary private\ninstitution of higher education in the Commonwealth.\t\t\t&#8220;Proprietary\nprivate institution of higher education&#8221; means any postsecondary school,\nas that term is defined in &#xA7; 23.1-213, in the Commonwealth that is\nprivately owned, privately managed, and obligated to pay federal income taxes in\nthe Commonwealth and is certified by the Council to offer degrees or exempt from\nsuch certification pursuant to Article 3 (&#xA7; 23.1-213 et seq.) of Chapter\n2.\t\t\t&#8220;Public institution of higher education&#8221; includes the System as\na whole and each associate-degree-granting and baccalaureate public institution\nof higher education in the Commonwealth.\t\t\t&#8220;State Board&#8221; means the\nState Board for Community Colleges.\t\t\t&#8220;System&#8221; means the Virginia\nCommunity College System.\t\t\t&#8220;Virginia student&#8221; means any student who\nhas established domicile in the Commonwealth pursuant to &#xA7; 23.1-502.\n\nHISTORY: 2016, c. 588; 2024, cc. 647, 684.","edition":{"id":2,"name":"2026","slug":"2026","date_created":"2026-07-16 18:40:23","date_modified":"2026-08-02 15:14:36","current":1,"order_by":2,"last_import":"2026-08-02 12:37:30"}}
